Terms and conditions of service provision

1. Definitions

  1. Service – the website available at websbutler.com.

  2. Service ProviderDaniel Xhemalçe, with its registered office at ul. Muśnickiego 8/1, 64-100 Leszno, Poland.

  3. User – a natural or legal person using the Service.

  4. Account – a collection of resources and permissions assigned to a specific User, created, for example, via a booking in the Amelia system.


2. General Provisions

  1. These Terms and Conditions define the rules for using the Service and the conditions for providing services electronically.

  2. Acceptance of the Terms and Conditions is voluntary but necessary to create an Account or place an order.


3. Types and Scope of Services

  1. The Service Provider provides services in the scope of: designing websites, online stores, listing portals, hosting services, WordPress maintenance, graphic design, and branding.

  2. Possibility to sign up for a free online consultation.

  3. User Account enabling management of consultations and contact history.


4. Conditions for Providing Services

  1. Using the Service requires a device with Internet access and an up-to-date web browser.

  2. It is prohibited to provide unlawful content.


5. Account Registration

  1. The Account is created by the User, e.g., during registration for a consultation via the booking form.

  2. The User undertakes to provide true and accurate data.


6. Rights and Obligations of the User

  1. The User has the right to use the Service in accordance with its intended purpose.

  2. The User is responsible for the confidentiality of their login data.

  3. The User undertakes not to provide content that violates the law or the rights of third parties.


7. Rights and Obligations of the Service Provider

  1. The Service Provider will make every effort to ensure that the Service functions without interruptions.

  2. The Service Provider reserves the right to temporary technical breaks.

  3. The Service Provider may block the Account in the event of a breach of the Terms and Conditions.


8. Payments

  1. Service prices are quoted in Euros (EUR) and include applicable VAT.

  2. The Service Provider offers two payment models:
    a) one-time payment,
    b) installment payments: 11 monthly installments + mandatory deposit.

  3. The deposit amount is fixed and independent of the selected payment model.

  4. The deposit is generally non-refundable, except for situations covered by the Conversion Guarantee (§9).

  5. Payments are made via bank transfer or other electronic methods indicated by the Service Provider.

  6. Invoices are issued in electronic form.


9. Complaints and Conversion Guarantee

  1. Complaints regarding services should be submitted to the e-mail address: info@websbutler.com.

  2. The Service Provider considers the complaint within 14 days of its receipt.

  3. Conversion Guarantee:
    a) If the new website does not achieve a conversion increase of at least 20% within 3 months of launch, the User has the right to choose one of two options:

    • refund of 100% of payments (including the deposit) with the simultaneous shutdown of the website,

    • refund of the deposit only while keeping the website active.
      b) Conversions are defined as: online sales, quote requests, sent contact forms, or other measurable indicators agreed upon jointly before implementation.
      c) Conversion growth is measured based on analytical data from the 3 months preceding the launch of the website compared to the period of 3 months after the launch.
      d) The User is obliged to provide analytical data (e.g., Google Analytics, Pixel) for the purpose of verifying results.
      e) The right to use the Conversion Guarantee applies exclusively to Clients who already had a website before concluding the contract and performed its renewal or redevelopment with the Service Provider. Clients who did not previously have a website cannot apply for a refund based on the Conversion Guarantee.
      f) The guarantee does not cover external factors, in particular lack of marketing activities, industry seasonality, or changes in the offer independent of the Service Provider.

  4. A request for a refund under the Conversion Guarantee must be submitted within 90 days of the website launch.


10. Withdrawal from the Contract

  1. A consumer may withdraw from the contract within 14 days without giving any reason, subject to Art. 38 of the Consumer Rights Act (services fully performed with express consent are not subject to refund).

  2. It is possible to cancel the service if it has not yet commenced.

  3. A template withdrawal form constitutes Annex No. 1 to these Terms and Conditions.


11. Liability

  1. The Service Provider is liable for non-performance or improper performance of the contract on the principles set out in the Civil Code, excluding lost profits.

  2. The Service Provider is not responsible for content and materials provided by the User.


12. Copyright

  1. The Service and its content are protected by copyright.

  2. In the case of custom projects, the User receives a non-exclusive license to use the project after making full payment.


13. Final Provisions

  1. The Terms and Conditions are subject to Polish law.

  2. In matters not regulated, the provisions of the Civil Code and the Act on Providing Services by Electronic Means shall apply.

  3. The Service Provider reserves the right to change the Terms and Conditions for important reasons (e.g., change in regulations). We will inform you about changes at least 14 days in advance.

  4. Archived versions of the Terms and Conditions will be available for download on the Service.
