1. Definitions
- Service – the website available at websbutler.com.
- Service Provider – Daniel Xhemalçe, based at ul. Skrzetuskiego 5A/1, 64-100 Leszno, Poland.
- User – a natural or legal person using the Service.
- Account – a set of resources and permissions assigned to a specific User, created e.g. through a booking in the Amelia system.
2. General Provisions
- These Terms set out the rules for using the Service and the conditions for providing services electronically.
- Accepting the Terms is voluntary, but required to create an Account or place an order.
3. Types and Scope of Services
The Service Provider offers services in the scope of:
- Designing websites, online stores, listing/offer sites, hosting services, WordPress maintenance, graphic design and branding.
- The ability to book a free online consultation.
- A user account allowing management of consultations and contact history.
4. Conditions for Providing Services
- Using the Service requires a device with internet access and an up-to-date browser.
- Submitting unlawful content is prohibited.
5. Account Registration
- An Account is created by the User, among other ways, when booking a consultation through the booking form.
- The User agrees to provide truthful information.
6. Rights and Obligations of the User
- The User has the right to use the Service in accordance with its intended purpose.
- The User is responsible for keeping their login details confidential.
- The User agrees not to share content that violates the law or the rights of third parties.
7. Rights and Obligations of the Service Provider
- The Service Provider will make an effort to keep the Service running without disruption.
- The Service Provider reserves the right to temporary technical downtime.
- The Service Provider may suspend an Account in the event of a breach of these Terms.
8. Payments
Service prices are stated in euros (EUR) and include applicable VAT. The Service Provider offers two payment models:
- a) a one-time payment,
- b) installment payments: 11 monthly installments + a mandatory deposit.
Other payment conditions:
- The deposit amount is fixed and independent of the chosen payment model.
- The deposit is generally non-refundable, except in situations covered by the Conversion Guarantee (§9).
- Payments are made by bank transfer or other electronic methods indicated by the Service Provider.
- Invoices are issued electronically.
9. Complaints and Conversion Guarantee
- Complaints regarding services should be submitted by email to: info@websbutler.com.
- The Service Provider will review the complaint within 14 days of receiving it.
Conversion Guarantee:
- a) If the new website does not achieve at least a 20% increase in conversions within 3 months of launch, the User is entitled to choose one of two options:
- a 100% refund of payments made (including the deposit) with the website simultaneously taken offline,
- a refund of the deposit only, with the website remaining active.
- b) Conversions are defined as: online sales, price inquiries, submitted contact forms, or other measurable indicators agreed jointly before work begins.
- c) The increase in conversions is measured based on analytics data from the 3-month period preceding the website launch, compared with the 3-month period following it.
- d) The User is required to provide access to analytics data (e.g. Google Analytics, Pixel) to verify the results.
- e) The right to use the Conversion Guarantee applies only to clients who already had a website before entering into the agreement and had it renewed or rebuilt by the Service Provider. Clients who did not previously have a website may not request a refund under the Conversion Guarantee.
- f) The guarantee does not cover external factors, in particular a lack of marketing activity, industry seasonality, or changes to the offer that are beyond the Service Provider's control.
A refund request under the Conversion Guarantee must be submitted within 90 days of the website's launch.
10. Withdrawal from the Agreement
- A consumer may withdraw from the agreement within 14 days without giving a reason, subject to Article 38 of the Polish Consumer Rights Act (services fully performed with the consumer's explicit consent are not subject to a refund).
- A service may be cancelled if work on it has not yet begun.
- A withdrawal form template is included as Appendix 1 to these Terms.
11. Liability
- The Service Provider is liable for non-performance or improper performance of the agreement under the rules set out in the Polish Civil Code, excluding lost profits.
- The Service Provider is not liable for content and materials supplied by the User.
12. Copyright
- The Service and its content are protected by copyright.
- For custom projects, the User receives a non-exclusive license to use the design after payment has been made in full.
13. Final Provisions
- These Terms are governed by Polish law.
- In matters not regulated herein, the provisions of the Polish Civil Code and the Act on Providing Services by Electronic Means shall apply.
- The Service Provider reserves the right to amend these Terms for important reasons (e.g. a change in the law). Changes will be announced at least 14 days in advance.
- Archived versions of these Terms will be available for download on the Service.
